TEMERLOH, Aug 20 (Bernama) -- The High Court here on Thursday acquitted and discharged a youth charged with murdering his girlfriend, three years ago.Judicial Commissioner Akhtar Tahir made the decision after finding the prosecution had failed to prove a prima facie case against the accused under Section 302 of the Penal Code.
In his judgement, Akhtar said the court was freeing Mohd Nazrul Shuhaimi, 18, without his defence being called because the prosecution failed to adduce any evidence linking him to the murder.He said among the failure of the prosecution was not calling a chemist to testify, not calling the parents who identified the victim to give testimony and failing to produce the knife said to be the murder weapon.
According to the facts, the accused was alleged to have murdered his girlfriend, Noraini Umar, who was 16 years old then, along a short cut road between Jengka 5 and Kuala Sentul, Sungai Jerik, Maran by stabbing her with a knife at around 4.30pm on Sept 2, 2006.
The prosecution had called nine witnesses since the trial began on Aug 24, 2007.Mohd Nazrul was represented by counsel Ahmad Nizam Hamid and Rozelan Abdul Rahman while Deputy Public Prosecutor Mohd Najmi Daud handled the prosecution.
Mohd Nazrul, who was wearing a white T-shirt and black track suit pants, was seen crying on hearing the judgement while his family members seated in the gallery started to scream in joy.-- BERNAMA
